Navigating Ethics in Litigation: Red Flags, Rules, and Reducing Risk
Ethical issues rarely arise without warning. More often, they develop from missed red flags, overlooked obligations, or difficult decisions made under pressure.
This engaging program follows litigation matters from client intake through settlement/trial and disengagement. Using realistic fact scenarios based on situations that litigators routinely encounter, judges and experienced practitioners will examine the ethical challenges that can arise throughout the entire litigation process.
The panel will analyze how the rules apply in real-world practice, identify warning signs before they become disciplinary concerns, and discuss practical strategies for addressing ethical issues when they arise. The discussion will focus not only on the Rules of Professional Conduct, but also on implementing sound practices to avoid problems before they escalate. Whether newly admitted or a seasoned litigator, participants will gain valuable insight into navigating ethical obligations from the beginning of a case through its final resolution.
